Mayor of the City of Ełk

announces the first oral limited tender

for sale of undeveloped land property, located in Ełk at Ogrodowa Street, marked in the land register report No. 1736 with an area of 0.0860 ha, disclosed in the Land and Mortgage Register No. OL1E/00013491/5.

According to the land register survey, the plot No: 1736 was marked as land use Bp – urbanized undeveloped areas or areas under development. The shape of the plot is regular, The relief of the terrain is generally even. The area of the property is partially wooded and overgrown with shrubs. Utilities in the road lane of Ogrodowa Street: network water, electricity, sanitary sewage, gas and Telecommunications.

There is no local plan Spatial Planning Authority, which would include in its findings immovable property in question. The plot is not located in the area of revitalisation or in the area of the Special Revitalisation Zone in accordance with the Revitalisation Act of 9 October 2015 (Journal of Laws of 2021, item 485, as amended).

Starting price of the property: 212.236,50 PLN gross (say: two hundred twelve thousand two hundred thirty-six zlotys 50/100), including VAT 23%.

Tender deposit: PLN 40,000.00 gross (say: forty thousand zlotys), including VAT 23%

Basis for sale:

a) In accordance with Order No. 1368.2023 of the President of the City of Ełk of August 18, 2023, the above-mentioned property is intended to be sold by means of an oral tender limited to the to owners (co-owners) and perpetual usufructuary adjacent properties, marked in the land register report precinct 2 Ełk 2 no.: 1735, 1737, 1738/4 and 1344/1.

The plot due to the lack of access to A public road cannot be developed as a separate property. This property may be developed together with one of the adjacent parcels.

b) The property in question is not encumbered with encumbrances or mortgages, and no proceedings are pending against it.

The tender will be held on January 16, 2024, at 10:00 a.m., in the conference room at the Ełk City Hall, 4 Piłsudskiego Street.

The restricted tender is open to persons who:

1) they are the owners of (co-owners) or perpetual usufructuary of real estate located in Ełk within the 2nd city of Ełk, marked in the survey Land Registry No. 1735, 1737, 1738/4 and 1344/1.

(10) The amount of the increment shall be determined by the tender participants, provided that the increment may not be less than 1% of the starting price, rounded up to the nearest tens of zlotys.

12) The price of the property shall be paid no later than by the date of concluding the sale agreement.

(14) If the person identified as the purchaser of the property does not enter into a contract without justification sales at the place and on the date specified in the notification, the tender may withdraw from concluding the sales contract and the tender deposit paid is non-refundable.

15) The Municipality of the City of Ełk has the right to pre-emption in accordance with the rules set out in the Act of 21 August 1997. on real estate management (Journal of Laws of 2023, item 344, as amended).

(16) When the immovable property is acquired by foreigner shall be subject to the provisions of the Act of 24 March 1920 on acquisition of real estate by foreigners (Journal of Laws of 2017, item 2278).

17) The seller is not responsible for the complex geotechnical conditions of the soil.

(18) The owner of the property participates in the in the costs of the construction of technical infrastructure equipment by contributing to the to the municipality of the levy.

(19) Possible connections to existing the buyer of the real estate will carry out the network by his own efforts and at his own expense, after consultation with the managers of the individual networks.

20) Possible felling of trees and shrubs located within the immovable property may be made in accordance with accordance with applicable laws. Any costs associated with this shall be borne by the buyer of real estate.

21) The costs of possible renewal of the boundary signs shall be borne by the purchaser of the property.

Pursuant to Article 152 of the Civil Code Owners of neighbouring land are obliged to cooperate in the demarcation of land and the maintenance of permanent boundary signs, demarcation costs and the costs of setting up and maintaining permanent signs border crossings shall bear half each.

 

This tender is launched after the expiry of the deadline (6 weeks from the date of publication of the list) to submission of an application by persons who are entitled to priority in the acquisition of immovable property pursuant to Article 34(1)(1) and (2) of the Act of 21 August 1997 on real estate management (Journal of Laws of 2023, item 344 of late. amended). Within the deadline set, no applications were received from persons who are entitled to priority in the acquisition of immovable property on the basis of of the above-mentioned provisions.

The Mayor of the City of Ełk may cancel the tender only for important reasons.

A tender participant may, within 7 days from the date of announcement of the result of the oral tender, challenge the related to conducting a tender to the Mayor of the City of Ełk.

The Mayor of the City of Ełk may accept the complaint considered justified and order the repetition of the tendering procedure or annul the call for tenders or declare the action unfounded. In the event of a complaint The Mayor of the City of Ełk suspends activities related to the sale of Property. The Mayor of the City of Ełk may cancel the tender only with important reasons. In the event of failure to challenge within the prescribed time limit, activities related to the conduct of the tender or, in the event that the complaint as unfounded, the Mayor of the City of Ełk will make public messages by posting on the notice board (first floor) in the Office of the City of Ełk for a period of 7 days, information on the result of the tender, which will be include, but is not limited to, the name or business name of the person identified as the purchaser of the immovable property.
